Facts of the Case - Culpable Driving


The accused was driving a car back from her beach house down on the Mornington Peninsula. She was travelling at the speed limit. An elderly person walked out onto the road in front of her car and was killed.

The Prosecution alleged that the car was not roadworthy and that the brakes were faulty. The accused had been to a mechanic and had the brakes fixed not long before the accident.
